Terms of Use
By filling out the order form or using the services of PowerHost.bg (Multi Computers Ltd.), the user agrees to comply with the terms of service, terms of use and privacy policy. Unless otherwise specified (terms of use, terms of service, privacy policy), the use of “us”, “we”, “our” will refer to PowerHost.bg (Multi Computers Ltd.). The use of “you”, “your” will refer to the user of PowerHost.bg (Multi Computers Ltd.).
1. General Terms
In connection with the receipt of the hosting services, the user undertakes to comply with the following terms:
1.1 The user undertakes to pay each month for the hosting services provided to him, unless he has pre-paid for a longer period of time;
1.2 The user undertakes to comply with the period for which he ordered the hosting service when filling out the online order form;
1.3 Failure to pay for the service will result in a seven-day warning, after which the service will be terminated;
1.4 PowerHost.bg is not responsible for the integrity of the information of any user who has not paid for the service within the agreed time, as a result of which the service has been terminated;
1.5 The user undertakes to pay all fees associated with his account.
2. Receiving the service
2.1 PowerHost.bg will deliver, the user will order and pay for the web hosting service;
3. Payment
3.1 The service starts after paying the specified amount;
3.1.1 The user undertakes to pay the full fee before PowerHost.bg starts delivering the service to him;
3.2 Payments are made on a specified date of the month. Any delay in payment without notice from you will result in a one-week notice and termination of the service.
4. Termination of the service
The user may terminate the service at any time, for any reason or for no reason through his client profile at https://www.powerhost.bg/clientarea.php
PowerHost.bg temporarily suspends the web hosting service if the client does not pay for its renewal within 3 days after the renewal date. If payment is not received within 14 days after the suspension of the hosting service, it is terminated and the data is irretrievably deleted from the servers and backups of PowerHost.bg
Reactivation of a deleted hosting account can be done after paying the relevant fee for the renewal of the specific service, as the deleted account is activated without containing the old client data. The client's information can be restored from a backup, if available.
Domains expire on the renewal date. For domains with the extensions com/net/org/info, renewal can be done at the same price if the payment is made within 15 days of the domain expiration. If more than 15 days have passed since the expiration of the domain with the extension com/net/org/info, it enters a penalty (redemption) period, in which the renewal can only be done by the owner, but the price for this is 150 BGN including VAT.
According to the rules of EURID (https://eurid.eu/), the registrar responsible for the registration, maintenance and renewal of domain names with the extension .eu does not have a grace period in which they can be paid and renewed without paying a penalty fee. Any .eu domain that is not renewed before its expiration date will expire and enter a penalty period immediately. A fee of 150.00 BGN including VAT will be due for its removal from the penalty period. A domain with the .eu extension will be considered paid if the payment for it has been received and reflected in the PowerHost.bg system before its expiration date.
Domains with the .de extension enter a redemption period 5 days before the end of the month in which they expire, regardless of their expiration date in the given month. After the domain expires, it is transferred to the .DE registry (DENIC), where it can be renewed only after contacting DENIC directly. After the expiration of .DE domains, PowerHost.bg is not responsible for the status of the domain and subsequent procedures or prices, as they are determined directly by DENIC (www.denic.de).
We recommend that all our clients who have domain registrations renew them at least 14 days before their expiration date. If you order a bank transfer on Friday or before holidays and official non-working days, please send us a copy of the payment to the e-mail office@powerhost.bg so that the payment can be reflected and the service can be renewed on time. Payment made before the expiration date, but not reflected in our system due to the technological time for receiving the bank transfer, will not be recognized as received and the service will expire.
In order for a domain to be transferred to PowerHost.bg, the domain must be unlocked for transfer by the current registrar, and its owner must have the transfer authorization code (EPP code), which is filled in when requesting the transfer. After confirmation by all parties, the domain transfer takes 7 days.
5. Data Backup
PowerHost.bg backs up the client's data in different ways and for different periods of time depending on the type of hosting service:
- Cpanel Linux hosting: 7 backups for the last 7 days.
- Plesk Windows hosting: No backup included.
- Cpanel Linux reseller hosting: 7 backups for the last 7 days.
- Plesk Windows reseller hosting: No backup included.
- Managed VPS: 1 backup for the last 24 hours with the option to pay extra for more.
- UnManaged VPS: No backup included. Option to purchase.
- Windows VPS: No backup included. Option to purchase.
- Dedicated servers: No backup included. Option to purchase.
The return of a backup is carried out by sending a request to the support department or through the control panel if one is available for the respective service.
The client does not have the right to use the web hosting service as a backup space for their data. Backups generated through the sPanel control panel must be downloaded via ftp and deleted from our server. PowerHost.bg reserves the right to delete backup files generated through sPanel and stored in the web hosting package.
PowerHost.bg does not offer a guarantee for the availability of backups at all times. The client is obliged to keep a backup of their data.
6. Communication with PowerHost.bg employees
PowerHost.bg treats all its clients with respect and expects the same from them. If a client insults any of the PowerHost.bg employees or affects them in any way, PowerHost.bg may terminate the service. The client will be notified by e-mail and will be given 24 hours to move their site to another provider.
7. Refunds and Disputes
The user has the option to terminate his first order at PowerHost.bg within 14 days and request a refund of the amounts paid in accordance with p.7.1 and p.7.2, without being obliged to justify his decision. PowerHost.bg reserves the right to inquire from the user about the reasons for his decision in order to improve the quality of its services.
7.1 Refundable payments:
- Base price for a hosting service, regardless of the type of hosting service.
- Additional ordered resources for hosting services, except for those mentioned in p.7.2
7.2 Non-refundable payments:
- Additional ordered licenses for hosting services (example: cPanel license, Litespeed license, etc.).
- Payments for registration, transfer or renewal of domain names.
- Payments for virtual or dedicated servers. ( VPS, Windows VPS, Deducated Servers )
- Installation fees for hosting services.
All refunds approved by PowerHost.bg will be refunded in the manner in which they were paid or another method expressly agreed upon with the user.
8. The user agrees not to engage in any actions that are in violation of the laws of the Republic of Bulgaria applicable to our services.
9. PowerHost.bg reserves the right to terminate the service in case of non-compliance with the terms and conditions of use of the service described below:
9.1 Terms of Use of the Service;
9.2 SPAM Policy.
10. PowerHost.bg SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR:
10.1 ANY INDIRECT OR INCIDENTAL DAMAGES – LOSS OF INFORMATION RESULTING FROM THE USE OF OUR SERVICES BY A USER OR THIRD PARTY OR,
10.2 ANY LOSS OF INFORMATION RESULTING FROM DELAYS, NON-PROVISION OR TERMINATION OF THE SERVICE.
10.3 PowerHost.bg ASSUMES NO RESPONSIBILITY FOR THE COMPLETENESS, ACCURACY OR USEFULNESS OF INFORMATION PROVIDED THROUGH OUR SERVICES, SYSTEMS, NETWORK OR INTERNET.
11. Communications
11.1 From PowerHost.bg to the User
PowerHost.bg will inform the User about everything that needs to be notified to the e-mail address that you have provided. The User is responsible for the messages sent to him and their non-receipt for any reason (change of e-mail address, deletion, redirection, blocking and so on).
